Online store www.silkdays.com is SIA "HOLMRE", reg. no. 51203064581, owned and maintained website.
1. As the sale of the product offered on www.silkdays.com takes place through an offer posted on the Internet, in accordance with Article 10 of the Consumer Rights Protection Law of the Republic of Latvia (PTAL), in this case a distance contract is concluded between the buyer and the seller.
2. When the Buyer visits and purchases goods in the online store www.silkdays.com, it is considered that the Buyer has read these Terms and Conditions in full and agrees with them.
3. SIA "HOLMRE" has the right to change the content and Terms and Conditions of the website and they come into force upon publication.
4. SIA "HOLMRE" is not responsible for any losses incurred by the user as a result of using the online store www.silkdays.com.
5. www.silkdays.com all indicated prices of goods are final and do not include Value Added Tax 21%, because SIA "HOLMRE" is not registered as a VAT payer at the moment. At the time of the discount offer, the offered prices are valid for the period indicated next to the item. The cost of the goods delivery service is not included in the indicated price of the goods.
5. www.silkdays.com prices are subject to change without notice. The changes take effect from the moment they are published in the online store www.silkdays.com and they apply to orders placed after the changes are published.
7. The tone of the product offered at www.silkdays.com may differ from the one shown in the picture (screen brightness, resolution, tone settings may differ for each computer and smart device), as well as may change due to room lighting. The product image may contain parts that are not included in the product.
8. The ordered product and the selected delivery service can be paid for by bank transfer, after receiving an invoice sent electronically (the product is sent when the money is credited to the bank account of SIA "HOLMRE" or if the buyer presents a bank-approved/signed payment order), by bank-link or by secure payment card system in the online store www.silkdays.com.
9. Within Baltic States (Latvia, Estonia, Lithuania) we deliver the ordered products using OMNIVA delivery machines - delivery is made to the delivery parcel selected by the buyer from the list available at www.silkdays.com. On average, delivery to OMNIVA parcel terminals takes 1-3 working days in Latvia and 2-5 working days to Estonia and Lithuania (if the order is placed by 10.00 on a business day and full payment has been received in the company's account by 12.00, and if the product is in stock and if the OMNIVA system load allows it). The buyer is informed about the arrival of the goods at the parcel terminal by a text message containing the door code, the location of the parcel terminal and the storage period. Parcel terminals operate 24 hours a day and the product is stored in the parcel terminal for 7 calendar days. If the buyer does not remove the goods within the specified time, the goods are sent back to SIA "HOLMRE" and the buyer is obliged to reimburse the costs related to the re-dispatch of the goods.
9.1. International orders we deliver by Latvian post service and usually it takes up to 30 days.
9.2. Buyer can choose also different delivery service (eg. FedEx/TNT, DHL and other) by messaging us at [email protected]. Price and terms are subject to be calculated and agreed before the payment is done.
10. The order is canceled if the invoice is not paid within 5 days of sending it to the buyer.
11. Before using the purchased product, the buyer is responsible for reading the product care instructions. Use the product only in accordance with the properties of the product and its intended use.
12. If you have reconsidered and decided to refuse the purchase, the Consumer Rights Protection Law of the Republic of Latvia (CPC) and the regulatory Regulations of the Cabinet of Ministers No. 255 "Regulations on Distance Contracts" (Cabinet Regulation No. 255) stipulate that the buyer has the right to withdraw from the contract 14 days and return the product purchased in the online store to the seller. Article 12 (11) of the PTAL provides that, in the case of a distance contract, "the consumer shall be liable for diminished value of the goods if they are used for purposes other than ascertaining the nature, characteristics and functioning of the goods. The consumer shall not be liable for diminished whether the service provider has not informed him or her of the right of withdrawal in accordance with the procedures specified in regulatory enactments regulating the protection of consumer rights ".
13. The guarantee specified in the relevant regulatory enactments applies to the goods sold in the www.silkdays.com online store. Claims received for non-compliance of the product with the contract will be resolved in accordance with the laws and regulations of the Republic of Latvia. 14. We remind you that the PTAL norms do not apply to cases when the product is purchased by legal entities.
15. In compliance with the legal norms of the Republic of Latvia, SIA "HOLMRE" shall retain the purchase agreements concluded with the buyers in the amount of time necessary for keeping the accounting.
16. Marketing activities:
16.1. www.silkdays.com is free to initiate various marketing activities, incl. loyalty programs.
16.2. In some cases, www.silkdays.com may give its customers a bonus www.silkdays.com discount coupon for actions taken.
16.3. In accordance with Clause 12, the buyer has the right to refuse the purchase in accordance with the procedures provided for in regulatory enactments.
16.4. When registering or making purchases in the online store www.silkdays.com, the buyer automatically subscribes to receive news by e-mail and SMS.
17. If the buyer wants to unsubscribe from receiving news by e-mail and / or SMS:
17.1. the buyer must send the application to our e-mail

18. Pictures, images as well as video material, text and intellectual property published on www.silkdays.com belong to SIA "HOLMRE". Copying and/or reproducing content, images and any information is strictly prohibited and illegal.
RETURNS & REFUND POLICY
1. If the Buyer is a consumer within the meaning of the Consumer Rights Protection Law (a physical person who expresses a wish to purchase, acquires or could purchase or use the goods or service for a purpose not related to his business or professional activity), the Buyer may exercise the right of withdrawal and unilaterally withdraw from the contract (purchase of goods in the online store) within 14 calendar days after delivery of the relevant goods. The buyer cannot exercise the right of withdrawal if:
1.1. goods are delivered that are made according to the Buyer's instructions or are irreplaceable things, or by their nature cannot be returned, or they are perishable or have been used.
1.2. if the price of the purchased goods or service depends on financial fluctuations which the seller cannot control;
1.3. in other cases provided by law.
2. The buyer may use the right of withdrawal in accordance with the following provisions:
2.1. The returned product must be in its original packaging and complete set, and the product and its assembly (eg box, information sheets, labels, etc.) must not be damaged.
2.2. The product and its accessories have not been used and have not lost their commercial appearance (labels, tags or other materials affixed to clothing and accessories have not been removed or damaged. Security films, stickers, etc. are intact).
2.3. The product must be in the same condition as it was at the time of receipt.
3. SIA "HOLMRE" reserves the right to charge a compensation fee or refuse to accept a product that is damaged, incomplete or otherwise lost its original appearance and / or properties.
4. SIA "HOLMRE" reserves the right to refuse to accept back the product if the deadlines for returning the product specified in regulatory enactments have not been observed.
5. A written (in electronic form to e-mail) notification sent to [email protected], indicating the purchased product and order number, is considered as an application for the exercise of the right of withdrawal. The buyer is obliged to indicate his bank account number to which the buyer wishes to receive a refund of the amount paid for the purchase of goods. SIA "HOLMRE" notifies the buyer about the receipt of the application, about the exercise of the right of withdrawal.
6. The buyer is obliged to return the goods to the seller within 14 (fourteen) days from the sending of the notice of refusal. The seller informs the buyer about the return address in Riga after receiving the application for the exercise of the right of withdrawal. When returning the product to the seller, the buyer must provide secure packaging for transporting the product. The costs related to the return of the goods are borne in full by the buyer.
7. The buyer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal. The buyer shall be liable for any diminution in the value of the goods if the goods have been used in a manner incompatible with the principle of good faith, including for purposes other than ascertaining the nature or functioning of the goods. The goods must be undamaged, have not lost the appearance of the goods (unremoved and undamaged labels, torn protective films, etc.) and unused. The product must be returned in its original packaging, in the same set and condition as it was received, as well as be accompanied by the purchase documents and all accessories of the product that were attached to it at the time of receipt. If the product is not fully assembled, is damaged, has lost its commercial appearance or is not properly packaged, SIA "HOLMRE" has the right not to accept the product, as well as not to refund the buyer the money paid for the product.
8. The seller is obliged to review the electronically received withdrawal request within 10 (ten) days and refund the payments received from it to the buyer, not later than within 14 (fourteen) days from the date of sending the buyer's withdrawal application. The seller has the right not to refund until the buyer has returned the goods. The seller refunds the money to the same bank account from which the payment was made for the product or the buyer's bank account specified in the buyer's withdrawal application sent by e-mail, or refunded to same bank card from what was made the purchase.
9. It is not possible to return the product purchased at discounts, but it is possible to exchange it for another product or gift card in the value of the product. Shipping costs are fully covered by buyer.
